A) SMS Terms of Use

1) Overview

These SMS Terms of Use (“Terms”) explain how Brixton Capital communicates with you via SMS text messaging. By opting in through our Microsoft Forms web opt-in form (link above), you agree to these Terms, as well as our general Terms & Conditions and Privacy Policy.

2) Consent (what you’re agreeing to)

By submitting our Microsoft Forms opt-in, you consent to receive 1-to-1 conversational SMS replies related to your inquiries (e.g., customer service, scheduling, follow-ups). Message frequency varies based on your interactions (typically 1–3 messages per inquiry). Standard message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. By submitting the form, you agree to these Terms and our Privacy Policy.

Sample message (for compliance): “Thanks for contacting Brixton Capital. We’ve received your message and will respond shortly. Reply STOP to unsubscribe or HELP for assistance.”

3) Cost & Message Frequency

Cost: We do not charge for texts; your carrier may apply standard message/data rates.

Frequency: The program is user-initiated and conversational. Message frequency varies (typically 1–3 messages per inquiry). We do not send automated marketing or promotional texts.

4) Opt-Out / Opt-In Again / Help

Opt-Out: Reply STOP (or QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE) to any message. You will receive a confirmation of your opt-out.

Opt-In Again: Reply START to re-subscribe.

Help: Reply HELP, or email info@brixtoncapital.com.

5) Customer Care

For customer support, email info@brixtoncapital.com (Mon–Fri, business hours PT). We aim to respond promptly during business hours.

6) Definitions

Opt-In: Your explicit consent to receive SMS text messages from Brixton Capital by submitting the Microsoft Forms opt-in form.

Text Message Service: 1-to-1 conversational plain-text SMS (no MMS/media) exchanged between you and Brixton Capital employees in response to your inquiries.

Microsoft Forms Opt-In: Our official online sign-up method where you provide your mobile number, review required disclosures (CTA, frequency, STOP/HELP), and submit explicit written consent.

7) E-Sign Disclosure

By opting in, you consent to the use of electronic records and signatures to document your agreement. You may withdraw consent via the opt-out procedure described above.

8) Arbitration & Class Action Waiver

Please read this section carefully. It affects your rights. Any dispute, claim, or controversy arising out of or relating to these Terms or the SMS Text Message Service (collectively, “Disputes”) will be resolved by binding arbitration on an individual basis, rather than in court, except that you and Brixton Capital may seek relief in small claims court if the claim qualifies. The Federal Arbitration Act and federal arbitration law apply to this agreement. The arbitration will be administered by JAMS pursuant to its applicable rules. The arbitrator has exclusive authority to resolve all Disputes, including relating to the interpretation, applicability, enforceability, or formation of this agreement to arbitrate. You and Brixton Capital agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Class arbitrations and class actions are not permitted. If a court determines that applicable law precludes enforcement of any of this paragraph’s limitations as to a particular claim or remedy, then that claim or remedy (and only that claim or remedy) must be severed from arbitration and may be brought in court. Venue for any permitted court proceeding will be in state or federal courts located in San Diego County, California, and you consent to personal jurisdiction there.

9) Changes to these Terms

We may update these Terms periodically. The Effective date at the top reflects the latest version. Continued use of the SMS service after updates constitutes acceptance of the revised Terms.

B) SMS Privacy Statement (Addendum)

1) What we collect for SMS

2) How we use this information

To deliver 1-to-1 SMS replies to your questions

We do not use SMS data for advertising or promotional marketing.

3) Sharing & Disclosure

We do not sell, rent, or share mobile numbers, opt-in data, or message content with third parties for marketing or promotional purposes. We share only the minimum necessary information with service providers to transmit messages (e.g., carriers and Microsoft Teams infrastructure), or when required by law.

4) Security

We apply reasonable administrative, technical, and physical safeguards. SMS travels over carrier networks, so confidentiality while in transit cannot be guaranteed.

5) Retention

We retain SMS-related data only as long as necessary to provide the service and meet compliance requirements, then securely delete it under our retention policies.
